Helping foreign investors gain a US EB-5 Visa

As a designated Regional Center under the US EB-5 Regional Center program, EB-5 New York State can help Foreign Investors qualify for an EB-5 visa in order to gain permanent US residence for the Foreign Investor, his or her spouse and children under 21 years of age.

What is an EB-5 Visa?
An EB-5 Visa is a type of US Visa which is only available to foreigners who invest $500,000 or $1 million into a commercial enterprise in the United States. 

What is the role of EB-5 New York State?
The US government designated EB-5 New York State as a Regional Center. As such, EB-5 New York State facilitates the investment of EB-5 capital into job creating commercial enterprises in New York State. A Foreign Investor applying for an EB-5 visa makes his or her investment into one of those job creating commercial enterprises.

How do I get an EB-5 Visa for me, my spouse and my children?
The specific rights and obligations of an investment will be stated in a Private Placement Memorandum, but the process will generally include:

Eligibility Review

EB-5 New York State conducts a background investigation and will request information from a potential Foreign Investor to determine if he or she is eligible for the EB-5 program.  Eligibility requirements include:

  1. The funds for the investment must come from a legitimate source,
  2. The Foreign Investor must be an Accredited Investor and
  3. Must pass a background check to indicate he or she is a person who should be granted a US visa.

Apply for EB-5 Visa

The Foreign Investor, as the person seeking a visa, will apply for an EB-5 visa.  In the application the Foreign Investor will indicate that the investment in the US will be made into the EB-5 New York State designated commercial enterprise.

Conditional Green Card Granted

Upon successful completion of immigration processing, the US Government will grant the Foreign Investor, his or her spouse and children under 21, a Conditional green card eligible for approximately two years.  That Conditional green card allows the Foreign Investor and his or her family to live in the US with all the rights and obligations of a US Permanent Resident.

Permanent Green Card Granted

After approximately two years, the Foreign Investor will file a petition for the conditions to be removed.  At that time, USCIS will examine the investment.  In general, upon USCIS determination that the investment was made and was "at risk" during the two-year period and created the required number of jobs, then the conditional nature of the green card will be removed and a regular green card will be issued. The Foreign Investor and his or her family will then be permanent green card holders and can, if they so choose, later apply to become U.S. citizens
